Planning Law
Planning law is all about our living environment and comprises planning & zoning law, environmental law, legislation on nature conservation, water law, and more. Planning law cannot be ignored when developing (real-estate) projects., and it is an area of law under constant development. Unlike other areas of law (such as the Dutch Civil Code), planning law has a habit of changing constantly.
It is important for the parties involved to be aware of this, and to anticipate potentially required permits and other authorisations well ahead. Subjects which may be addressed in this regard are: spatial planning (previously called zoning plan), the authority to derogate from the spatial planning, planning permissions for different activities (this may refer, for instance, to the former building & monument permit), permits under the Dutch Housing Allocation Act, and all kinds of other permits needed for the realisation of projects and for the business operations, or for the use of buildings.
